Ipak, u praksi se \u010desto postavlja pitanje \u0161ta kada poslodavac odbije odobriti godi\u0161nji odmor, uslovljava njegovo kori\u0161tenje ili \u010dak tra\u017ei od radnika da se odrekne tog prava.<\/p>\n<p data-start=\"385\" data-end=\"690\">Zakoni o radu u Bosni i Hercegovini jasno propisuju da je godi\u0161nji odmor zakonsko pravo svakog zaposlenog i da ga poslodavac ne mo\u017ee proizvoljno uskratiti. Iako postoje odre\u0111ene razlike izme\u0111u Federacije BiH, Republike Srpske, Br\u010dko distrikta i institucija BiH, osnovna prava radnika su gotovo identi\u010dna.<\/p>\n<h2 data-section-id=\"rouu91\" data-start=\"692\" data-end=\"723\">Koliko traje godi\u0161nji odmor?<\/h2>\n<p data-start=\"725\" data-end=\"1077\">U Federaciji Bosne i Hercegovine radnik za svaku kalendarsku godinu ima pravo na <strong data-start=\"806\" data-end=\"884\">pla\u0107eni godi\u0161nji odmor u trajanju od najmanje 20, a najvi\u0161e 30 radnih dana<\/strong>. Kolektivnim ugovorom ili pravilnikom o radu mo\u017ee biti propisan i du\u017ei godi\u0161nji odmor, zavisno od prirode posla i uslova rada. Maloljetni radnici imaju pravo na najmanje 24 radna dana odmora.<\/p>\n<p data-start=\"1079\" data-end=\"1246\">Sli\u010dna rje\u0161enja va\u017ee i u Republici Srpskoj, Br\u010dko distriktu te institucijama Bosne i Hercegovine, gdje je tako\u0111er propisan minimalni godi\u0161nji odmor od 20 radnih dana.<\/p>\n<h2 data-section-id=\"myo019\" data-start=\"1248\" data-end=\"1298\">Kada radnik sti\u010de pravo na puni godi\u0161nji odmor?<\/h2>\n<p data-start=\"1300\" data-end=\"1486\">Radnik koji prvi put zasniva radni odnos ili je imao prekid izme\u0111u dva zaposlenja du\u017ei od 15 dana u Federaciji BiH sti\u010de pravo na puni godi\u0161nji odmor nakon \u0161est mjeseci neprekidnog rada.<\/p>\n<p data-start=\"1488\" data-end=\"1621\">Ako jo\u0161 nije ispunio taj uslov, ipak nije bez prava. Za svaki navr\u0161eni mjesec rada ima pravo na najmanje jedan dan godi\u0161njeg odmora.<\/p>\n<p data-start=\"1664\" data-end=\"1805\">Plan kori\u0161tenja godi\u0161njeg odmora utvr\u0111uje poslodavac, ali pritom mora voditi ra\u010duna o potrebama procesa rada i opravdanim interesima radnika.<\/p>\n<p data-start=\"1807\" data-end=\"1965\">Poslodavac je du\u017ean radnika <strong data-start=\"1835\" data-end=\"1916\">pisanim putem obavijestiti najmanje sedam dana prije po\u010detka godi\u0161njeg odmora<\/strong>, navode\u0107i njegovo trajanje i period kori\u0161tenja.<\/p>\n<h2 data-section-id=\"1hl7m95\" data-start=\"1967\" data-end=\"2019\">Mo\u017ee li se godi\u0161nji odmor koristiti u dijelovima?<\/h2>\n<p data-start=\"2021\" data-end=\"2026\">Mo\u017ee.<\/p>\n<p data-start=\"2028\" data-end=\"2259\">Zakon omogu\u0107ava kori\u0161tenje godi\u0161njeg odmora u dva dijela. U tom slu\u010daju prvi dio mora trajati najmanje 12 radnih dana bez prekida tokom teku\u0107e kalendarske godine, dok se preostali dio koristi najkasnije do 30. juna naredne godine.<\/p>\n<p data-start=\"2261\" data-end=\"2410\">Osim toga, radnik ima pravo da jedan dan godi\u0161njeg odmora koristi kada on \u017eeli, uz obavezu da poslodavca o tome obavijesti najmanje tri dana ranije.<\/p>\n<h2 data-section-id=\"wfyrgt\" data-start=\"2412\" data-end=\"2475\">Mo\u017ee li poslodavac isplatiti novac umjesto godi\u0161njeg odmora?<\/h2>\n<p data-start=\"2477\" data-end=\"2492\">U pravilu \u2013 ne.<\/p>\n<p data-start=\"2494\" data-end=\"2656\">Zakonom je izri\u010dito propisano da se radnik <strong data-start=\"2537\" data-end=\"2579\">ne mo\u017ee odre\u0107i prava na godi\u0161nji odmor<\/strong>, niti mu poslodavac mo\u017ee ponuditi nov\u010danu naknadu umjesto kori\u0161tenja odmora.<\/p>\n<p data-start=\"2658\" data-end=\"2847\">Jedini izuzetak je prestanak radnog odnosa, kada radnik zbog odlaska iz firme nije imao mogu\u0107nost iskoristiti preostali godi\u0161nji odmor. Tada poslodavac mora isplatiti odgovaraju\u0107u naknadu.<\/p>\n<h2 data-section-id=\"ehjvxx\" data-start=\"2849\" data-end=\"2898\">\u0160ta ako poslodavac odbija dati godi\u0161nji odmor?<\/h2>\n<p data-start=\"2900\" data-end=\"3001\">Pravnici isti\u010du da poslodavac ne mo\u017ee jednostrano uskratiti zakonsko pravo radnika na godi\u0161nji odmor.<\/p>\n<p data-start=\"3003\" data-end=\"3072\">Ako se to ipak dogodi, preporu\u010duje se sljede\u0107i redoslijed postupanja:<\/p>\n<ul data-start=\"3074\" data-end=\"3415\">\n<li data-section-id=\"iwrkvc\" data-start=\"3074\" data-end=\"3143\">podnijeti pisani zahtjev poslodavcu za kori\u0161tenje godi\u0161njeg odmora;<\/li>\n<li data-section-id=\"8evs23\" data-start=\"3144\" data-end=\"3205\">zatra\u017eiti pisano obrazlo\u017eenje ukoliko zahtjev bude odbijen;<\/li>\n<li data-section-id=\"m9dfb0\" data-start=\"3206\" data-end=\"3270\">obratiti se sindikatu ili vije\u0107u zaposlenika, ukoliko postoji;<\/li>\n<li data-section-id=\"1x5ugt8\" data-start=\"3271\" data-end=\"3317\">podnijeti prijavu nadle\u017enoj inspekciji rada;<\/li>\n<li data-section-id=\"fqehp5\" data-start=\"3318\" data-end=\"3415\">pokrenuti sudski postupak radi za\u0161tite prava iz radnog odnosa ukoliko problem ne bude rije\u0161en.<\/li>\n<\/ul>\n<h2 data-section-id=\"qc6yqy\" data-start=\"3417\" data-end=\"3451\">Kakva je uloga inspekcije rada?<\/h2>\n<p data-start=\"3453\" data-end=\"3581\">Inspekcija rada nadzire primjenu Zakona o radu i mo\u017ee reagovati kada poslodavac radnicima uskra\u0107uje zakonom zagarantovana prava.<\/p>\n<p data-start=\"3583\" data-end=\"3750\">U Federaciji BiH zakon predvi\u0111a prekr\u0161ajne sankcije za poslodavce koji radnicima ne omogu\u0107e kori\u0161tenje minimalnog godi\u0161njeg odmora ili im nezakonito uskrate to pravo.<\/p>\n<h2 data-section-id=\"83fpyr\" data-start=\"3752\" data-end=\"3808\">Da li radnik prima platu za vrijeme godi\u0161njeg odmora?<\/h2>\n<p data-start=\"3810\" data-end=\"3813\">Da.<\/p>\n<p data-start=\"3815\" data-end=\"4025\">Za vrijeme kori\u0161tenja godi\u0161njeg odmora radnik ima pravo na naknadu plate u visini koju bi ostvario da je radio. Drugim rije\u010dima, kori\u0161tenje godi\u0161njeg odmora ne smije imati negativan uticaj na njegova primanja.<\/p>\n<h2 data-section-id=\"isn884\" data-start=\"4027\" data-end=\"4093\">Mogu li poslodavci prisiliti radnike da koriste godi\u0161nji odmor?<\/h2>\n<p data-start=\"4095\" data-end=\"4228\">Poslodavac odre\u0111uje raspored godi\u0161njih odmora, ali to mora \u010diniti u skladu sa zakonom i uz uva\u017eavanje opravdanih interesa zaposlenih.<\/p>\n<p data-start=\"4230\" data-end=\"4423\">S druge strane, radnik ne mo\u017ee samostalno odlu\u010diti kada \u0107e koristiti cijeli godi\u0161nji odmor bez saglasnosti poslodavca, osim prava na jedan dan godi\u0161njeg odmora pod zakonom propisanim uslovima.<\/p>\n<p data-start=\"4439\" data-end=\"4839\">Godi\u0161nji odmor nije privilegija koju poslodavac mo\u017ee dati ili uskratiti prema vlastitoj procjeni, ve\u0107 zakonom zagarantovano pravo svakog zaposlenog. Minimalno trajanje odmora u Bosni i Hercegovini uglavnom iznosi 20 radnih dana, a radnici koji smatraju da im je ovo pravo uskra\u0107eno mogu za\u0161titu zatra\u017eiti kroz pisani zahtjev poslodavcu, obra\u0107anje sindikatu, prijavu inspekciji rada ili sudskim putem.<\/p>\n<p data-start=\"4841\" data-end=\"5114\">Stru\u010dnjaci iz oblasti radnog prava upozoravaju da se radnici ne bi trebali odricati godi\u0161njeg odmora niti pristajati na neformalne dogovore kojima se ovo pravo zaobilazi, jer zakon jasno propisuje da je godi\u0161nji odmor sastavni dio za\u0161tite zdravlja i sigurnosti zaposlenih.<strong>\/Tuzlainfo.ba\/<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ljetni period tradicionalno je vrijeme kada veliki broj radnika koristi godi\u0161nje odmore.
